Facts
Winston Cigarette Machine Company (Winston) (plaintiff) sued Wells-Whitehead Tobacco Company (Wells-Whitehead) (defendant) for breach of contract. The jury found that Wells-Whitehead willfully and unjustifiably breached the contract and awarded Winston damages in part based on lost profits. Wells-Whitehead appealed, arguing that such profits were too speculative to be recoverable.
