Facts

Zion Williamson (plaintiff) entered into an agreement with Prime Sports Marketing, LLC, and its agent, Gina Ford (collectively, Prime Sports) (defendants), authorizing Prime Sports to negotiate professional-sports-services and endorsement contracts on Williamson’s behalf. At the time, Williamson was enrolled at Duke University and played on the men’s basketball team. Williamson brought suit seeking a declaration that the agreement was void under North Carolina’s Uniform Athlete Agent Act (UAAA) because Ford was not a registered athlete agent. Alternatively, Williamson argued the agreement was voidable because it lacked the UAAA’s required warning language. Prime Sports countered that the UAAA did not apply because Williamson was not a student athlete at the time of signing. Prime Sports generally alleged that Williamson had engaged in conduct rendering him permanently ineligible to participate in collegiate sports. Williamson moved for judgment on the pleadings.
