Facts
The Federal Bureau of Investigation (FBI) suspected Zein Hassan Isa (defendant) of working for the Palestine Liberation Organization. Pursuant to the Foreign Intelligence Surveillance Act (FISA), the FBI obtained an order to bug Isa’s home. The FBI’s recording device recorded Isa’s murder of his 16-year-old daughter. Isa was charged with the murder, and he filed a motion to suppress the recordings from his house on the ground that the murder was not relevant to any foreign intelligence. The district court denied the motion. Isa appealed.
