Facts
Dorothy Imhoff (defendant) and James Desmond co-owned a commercial property that Desmond managed. Desmond blocked the fire exit of a nightclub that was leased on Desmond and Imhoff’s property. Desmond blocked the fire-exit doors by digging a trench and building barriers on a separate, adjacent property in which Imhoff had no ownership interest. The blockages resulted in fire-code violations, forcing the nightclub to temporarily close twice. The nightclub owners (plaintiffs) reopened the nightclub after they were granted an injunction against Desmond. The nightclub owners sought to recover monetary damages from Desmond until Desmond died. The nightclub owners then withdrew their action against Desmond’s estate and filed a complaint against Imhoff. Imhoff filed a motion for a directed verdict denying liability for Desmond’s torts, which was denied. The nightclub owners were awarded $44,000 after a jury trial. Imhoff appealed to the Connecticut Appellate Court.
