Facts
The State of New Jersey (plaintiff) brought an enforcement action against Ran-Dav’s County Kosher, Inc. (defendant) for violating the state’s kosher-food regulations. The regulations made it a crime to sell food falsely represented as kosher. “Kosher” was defined as “prepared and maintained in strict compliance with the laws and customs of the Orthodox Jewish religion.” The Chief of the Bureau of Enforcement was an Orthodox rabbi, and the Advisory Committee consisted entirely of rabbis. Ran-Dav’s appealed the enforcement, arguing that the regulations violated the Establishment Clause and the state constitution. The appellate court upheld the regulations and Ran-Dav’s appealed to the New Jersey Supreme Court.
