Facts
Public Service Company of Indiana (PSI) requested a market-based rate for the sale of up to 450 megawatts of power from the Federal Energy Regulatory Commission (commission) (defendant). UtilCo Group, Inc. (UtilCo) (plaintiff) opposed the request. The commission granted the request, and UtilCo requested a hearing. UtilCo argued that the commission exceeded its authority to approve just and reasonable rates under §§ 205 and 206 of the Federal Power Act (FPA) by accepting a wholesale rate by a regulated public utility that was capped at the buyer’s avoided costs. UtilCo argued that a just and reasonable rate could only be determined based on a variety of seller’s costs.
