Facts
Lessoff (defendant) was a partner in the law firm Lessoff & Berger (defendant). Lessoff routinely referred personal-injury clients to a radiologist for examinations and reports on injuries. Lessoff instructed the radiologist to falsify the reports. The radiologist was working undercover with authorities and recorded his telephone conversations with Lessoff. No evidence implicated any members of the law firm other than Lessoff. The Lessoff & Berger partnership was indicted for insurance fraud, falsifying business records, and attempted grand larceny. Lessoff & Berger moved to dismiss the indictment in the New York Supreme Court.
