Facts
W.G. Brown (plaintiff) transferred some gold and other valuables to his daughter, Billie Jean McCune (defendant), for the purpose of hiding those assets during a divorce proceeding. McCune placed the gold and valuables in a safe deposit box. After the divorce was finalized, Brown requested the gold and valuables back, but McCune refused. Brown sued McCune and sought a temporary restraining order preventing McCune from taking any of the gold or valuables. The trial court determined that Brown had not made a completed gift and was entitled to the return of the gold and valuables. McCune appealed.
