Facts
Phillip Le Francois and Eric Herald (plaintiffs) sued their former employer and three of its officers (defendants), alleging that the officers had made injurious misrepresentations and false promises. The individual defendants moved for summary judgment, but the motion was denied. Over a year later, the individual defendants again moved for summary judgment based on the same evidence and argument as the first motion. The trial court granted this motion. The plaintiffs appealed. The California Court of Appeal affirmed the judgment, and the plaintiffs petitioned the California Supreme Court for review.
