Facts
Kaiser Hawaii Kai Development Company (Kaiser) (plaintiff) wanted to develop a residential-housing project on a tract of land in the city and county of Honolulu (the city) (defendant). The tract was zoned for residential use. A group of Honolulu citizens opposed the housing project and attempted to place an initiative petition on the ballot. The initiative petition proposed changing the zoning designation of the tract from residential to preservation. This required amending the city’s comprehensive plan, which established the city’s system of land-use regulation. Kaiser brought suit, seeking to enjoin the placement of the initiative petition on the ballot. The circuit court granted the injunction. The city appealed.
