Facts
Since 1978, Investacorp, Inc. (plaintiff) had provided financial services to individuals, corporations, and institutions seeking investment opportunities under the name Investacorp. Then, in 1983, Investcorp E.C. and Investcorp International (collectively, Investcorp) (defendant), an investment bank headquartered in Bahrain, began doing business in the United States under the name Investcorp. Investacorp sued Investcorp for trademark infringement and unfair competition. Having determined that Investacorp did not have a protectable interest in the mark Investacorp, the district court granted summary judgment in favor of Investcorp. Investacorp appealed.
