Facts
Myrna L. Thiemann died intestate, leaving behind three aunts as her closest surviving relatives. Thiemann’s aunt Eleanor M. Woodside (plaintiff) shared both a mother and a father with Thiemann’s mother. Thiemann’s aunts Marcella M. Will and Martha M. Hyatt (defendants) shared only a father with Thiemann’s mother. At a trial to determine how Thiemann’s estate should be divided, Woodside argued that, because she was Thiemann’s relative of the whole blood, she should receive twice as much as Will and Hyatt, who were relatives of the half blood. A trial court held that each aunt was entitled to a one-third share of Thiemann’s estate, reasoning, among other things, that the state’s half-blood statute only applied to distributions among the siblings of the deceased. Woodside appealed.
