Facts
Griffith (plaintiff) was standing nearby when agents of Valley of the Sun Recovery and Adjustment Bureau (defendant) came to repossess his neighbor’s car. During the attempted repossession, Griffith was shot with a shotgun. Griffith sued, arguing that Valley was negligent per se for causing a breach of the peace while attempting to repossess the car. The court granted summary judgment in Valley’s favor, and Griffith appealed.
