Facts
Englebert Ngcobo and two other individuals (plaintiffs) worked for several months at a mercury plant in South Africa, where they were exposed to hazardous levels of mercury. Ngcobo was hospitalized soon after and died in the hospital a few years later. Ngcobo’s widow brought suit in England on behalf of his estate against Thor Chemicals (defendant), which owned the mercury plant. Ngcobo argued that the negligence of Thor Chemicals caused the plant workers’ exposure to hazardous levels of mercury. Thor Chemicals sought a stay of the proceedings based on forum non conveniens.
