Facts
Crysco Oilfield Services, Incorporated (Crysco) (plaintiff) purchased shale shakers from Hutchinson-Hayes International, Incorporated (Hutchinson) (defendant). Shale shakers are machines used in the oil-well business. Crysco purchased the machines for their ordinary use in the oil-well-servicing process. Crysco alleged that the shale shakers did not work as intended. Crysco sued Hutchinson for breach of an implied warranty of fitness for a particular purpose. Hutchinson moved for a directed verdict on this claim at trial, which the district court denied. The jury entered judgment in favor of Crysco. Hutchinson appealed to the United States Court of Appeals for the Tenth Circuit.
