Facts
Charles Hinds (defendant) consented to a search of his computer for electronic mail. While conducting the search, the police officer found child pornography. The officer seized the computer and obtained a search warrant for the computer’s contents. A search revealed thousands of images of child pornography stored on the computer. Hinds was charged with unlawful possession of child pornography. Hinds’s motion to suppress the images found on his computer was denied. Hinds was convicted and argued on appeal that the officer’s search exceeded the scope of Hinds’s consent and that it was unreasonable for the officer to open files in a directory and to seize the computer.
