Facts
Alice Bobo (plaintiff), a Black woman, was fired from her job at ITT, Continental Baking Company (ITT) (defendant). Bobo brought suit, contending that ITT discriminated against her because of her race and sex in violation of 42 U.S.C. § 1981. The district court ruled that sex discrimination did not fall within the purview of § 1981. Thus, the district court held that Bobo was entitled to a trial only on the issue of whether she had been subjected to racial discrimination. Bobo appealed.
