Facts
A.S. Wikstrom, Inc. (A.S.) (plaintiff) sued the Tug Julia C. Moran (tug) (defendant) after A.S.’s ship sank while under tow from the tug. Before undertaking the tow, the tug’s captain did a short inspection of A.S.’s ship. The weather was good. During the tow, several crew members took turns keeping an eye on A.S.’s ship. While the towing started normally, the ship began to sink. Although the tug took measures to save the ship, the ship sank before the tug could beach it. A.S. argued that the tug was liable because it should have noted that A.S.’s ship was sinking sooner.
